Project Terms & Conditions

Last Updated: August 2026

These Project Terms & Conditions apply to mural, artwork, consultancy, workshop and other creative services provided by Street Art Concepts.

By accepting a quote, paying a deposit, approving commencement of work or otherwise engaging Street Art Concepts, the Client agrees to these Terms & Conditions together with any project-specific terms contained in the relevant quote, proposal or written agreement.

Where a project-specific written agreement expressly differs from these Terms, the project-specific agreement will apply to the extent of that inconsistency.

1. Quotes & Project Scope

Quotes are prepared based on the information available at the time, including the proposed artwork, dimensions, location, surface condition, access requirements, timeframe and other project requirements.

Unless otherwise stated, a quote covers only the work specifically described within it.

Additional work, changes to the scope or circumstances that could not reasonably have been identified when quoting may result in additional charges.

Quotes remain valid for the period specified on the quote.

2. Deposits & Booking

A project is not considered confirmed until any required deposit has been received and Street Art Concepts has confirmed the booking.

Deposits secure project time and allow concept development, planning and other project preparation to commence.

The deposit amount and payment schedule will be specified in the project quote.

Unless otherwise required by law, deposits may become non-refundable once design, planning, purchasing or other project work has commenced.

3. Payment

Payment terms will be specified on the relevant invoice or quote.

Depending on the scale of the project, payment may be structured as:

  • Deposit on acceptance
  • Progress payments
  • Payment before installation
  • Final payment following completion

Invoices must be paid by the due date stated.

Street Art Concepts reserves the right to postpone design work, installation or further services where an invoice remains overdue.

4. Design & Concept Development

Creative concepts are developed based on the agreed project brief, information supplied by the Client and the artist’s creative interpretation.

The Client is responsible for providing clear and accurate information regarding their requirements before design work begins.

Concept sketches, digital mock-ups and visualisations are intended to communicate the proposed artistic direction. They may not represent every fine detail, texture or variation present in the final hand-created artwork.

5. Design Revisions

The number of design revisions included in the project will be specified in the quote or proposal where applicable.

Revisions outside the included allowance, significant changes to the original brief or requests to restart an approved creative direction may incur additional design fees.

We encourage Clients to provide consolidated feedback during the approval process to help keep the project moving efficiently.

6. Artwork Approval

The Client must approve the final creative direction before installation begins.

Approval may be provided by email, signed documentation or another agreed written method.

Once artwork has been approved, significant changes requested by the Client may result in additional costs and changes to the project schedule.

Due to the hand-created nature of mural and street art, minor variations between an approved concept and the finished artwork are normal and form part of the artistic process.

7. Original Artwork & Reference Images

Reference photographs, artwork and inspiration supplied by the Client may be used to establish preferred subject matter, style, colour or creative direction.

Street Art Concepts does not undertake to reproduce another artist’s work without appropriate permission.

Where reference material is supplied, the intention will generally be to create an original artistic interpretation rather than an exact copy.

The Client is responsible for ensuring they have appropriate rights or permission to supply logos, photographs, characters, graphics or other protected material they specifically request to be reproduced.

8. Artist Selection & Collaboration

Street Art Concepts operates as a mural studio, street art consultancy and collaborative creative network.

Depending on the project, work may be completed by Dan Krause (Drule Art), another artist, or a team of collaborating artists.

Where appropriate, Street Art Concepts may recommend or engage artists whose particular style or skills are suited to the project.

Unless a specific artist has been expressly agreed as part of the project, Street Art Concepts may determine the appropriate creative team required to deliver the agreed work.

9. Site & Surface Condition

The Client must disclose any known issues affecting the proposed artwork surface, including moisture, structural damage, deteriorating paint, contamination or other conditions that may affect adhesion or longevity.

Unless specifically included in the quote, substantial repairs, structural work, waterproofing or specialist building preparation are not included in the mural service.

If previously unidentified surface problems become apparent after work commences, Street Art Concepts may recommend additional preparation, modify the proposed painting method or pause work until the issue is addressed.

Additional work may be quoted separately.

10. Site Access

The Client is responsible for providing reasonable and safe access to the project site at agreed times.

This includes arranging any required access through buildings, gates, loading areas, security systems or restricted areas.

Unless otherwise included in the quote, the Client may also be responsible for ensuring that the immediate work area is clear of furniture, vehicles, stock, landscaping or other obstructions before installation begins.

Delays caused by unavailable or restricted access may result in additional costs.

11. Height Access & Equipment

Some mural projects require scaffolding, elevated work platforms, lifts or other specialist access equipment.

Responsibility and costs for this equipment will be specified in the quote where known.

If site conditions require access equipment that was not reasonably identifiable when quoting, additional costs may apply subject to discussion with the Client.

12. Outdoor Projects & Weather

Exterior mural projects are affected by weather.

Rain, excessive heat, high winds, humidity or other unsuitable conditions may require installation to be delayed, suspended or rescheduled.

Street Art Concepts will make reasonable efforts to manage the project schedule but cannot guarantee exterior completion dates where weather or other conditions outside our reasonable control affect the work.

Weather-related delays do not constitute cancellation of the project.

13. Project Scheduling

Any commencement or completion dates provided are based on information available at the time and may be affected by factors including:

  • Weather
  • Site access
  • Client approvals
  • Surface preparation
  • Availability of equipment
  • Changes to the project scope
  • Artist availability
  • Circumstances outside reasonable control

Where delays occur, Street Art Concepts will communicate revised timing where reasonably possible.

14. Cancellations & Postponements

If the Client cancels or postpones a confirmed project, Street Art Concepts may retain amounts reasonably attributable to work already completed and costs already incurred, subject to applicable Australian law.

This may include design time, administration, purchased materials, booked travel, accommodation, equipment hire and reserved artist time where losses cannot reasonably be recovered.

Any additional cancellation or postponement conditions stated in the project quote will also apply.

15. Travel & Accommodation

Projects outside the normal Brisbane service area may involve travel, accommodation, transport, freight or other expenses.

These costs will be included in the quote where known or otherwise agreed with the Client before being incurred.

Changes to confirmed travel arrangements requested by the Client may result in additional charges.

16. Changes During Installation

Once painting has commenced, changes to approved artwork may not always be practical.

Where changes are possible, additional design, labour, materials, equipment or time may be charged separately.

Street Art Concepts will discuss significant requested changes and their likely impact before proceeding wherever reasonably possible.

17. Artistic Variation

Murals and commissioned artworks are created by hand.

Spray techniques, brushwork, texture, surface characteristics and the scale of the artwork naturally produce variations that cannot be replicated exactly in digital concepts.

These characteristics are part of commissioning original artwork rather than purchasing a mechanically reproduced product.

18. Outdoor Artwork & Longevity

Street Art Concepts uses materials selected according to the project, surface and intended environment.

However, exterior artwork is naturally exposed to UV, rain, heat, moisture, pollution, physical wear and other environmental conditions.

The lifespan and appearance of a mural will therefore depend on factors outside the artist’s control, including the condition of the underlying surface and ongoing maintenance.

No exterior artwork should be considered permanently fade-proof or maintenance-free unless a specific written warranty states otherwise.

19. Protective Coatings

Protective coatings or sealants may be recommended for certain projects and will only be included where specified in the quote.

Protective coatings can assist with durability but cannot prevent all fading, deterioration, vandalism, substrate failure or environmental damage.

20. Maintenance & Repairs

Murals may require cleaning, maintenance, touch-ups or protective recoating over time.

Future maintenance is not included in the original project price unless expressly stated.

Street Art Concepts may provide maintenance recommendations or quote for future restoration and touch-up work where appropriate.

21. Damage Outside Our Control

Street Art Concepts is not responsible for deterioration or damage caused by circumstances outside our reasonable control, including:

  • Structural movement or cracking
  • Water or moisture ingress
  • Failure of existing paint or render
  • Mould or contamination
  • Building repairs
  • Vandalism or graffiti
  • Accidental damage
  • Pressure cleaning or inappropriate cleaning products
  • Extreme weather
  • Alterations made by third parties

22. Copyright

Unless otherwise agreed in writing, copyright in original concepts, designs, sketches, illustrations and artwork remains with the artist who created the work.

Payment for a mural or commissioned artwork does not automatically transfer copyright.

The Client receives the physical artwork and the right to display and enjoy it for its intended purpose, subject to any additional rights agreed for the project.

23. Commercial Reproduction & Licensing

Artwork must not be reproduced for commercial purposes without appropriate permission from the copyright owner.

Commercial reproduction may include use on:

  • Merchandise
  • Apparel
  • Packaging
  • Products
  • Advertising campaigns
  • Printed promotional material
  • Digital products
  • Reproductions offered for sale

Where commercial usage is required, licensing terms can be discussed and incorporated into the project agreement.

This does not prevent incidental photography of a mural in its normal environment or ordinary promotion of the Client’s premises unless otherwise agreed.

24. Photography & Portfolio Use

Unless otherwise agreed in writing, Street Art Concepts and the participating artist may photograph completed artwork and use those images to document and promote their work, including through:

  • Websites
  • Portfolios
  • Social media
  • Award submissions
  • Media
  • Promotional material

Where a project is confidential, contains sensitive information or is subject to publication restrictions, the Client should advise Street Art Concepts before work commences so appropriate arrangements can be agreed.

25. Removal or Alteration of Artwork

Unless otherwise agreed, ownership or control of the physical wall, object or structure remains with its owner.

Street Art Concepts does not guarantee that a mural will remain permanently displayed.

Where legally applicable, the artist’s moral rights should be respected when artwork is altered, relocated, attributed or treated in a manner affecting the integrity of the work.

Clients should seek specific advice where redevelopment, removal or significant alteration of commissioned artwork is contemplated.

26. Client-Supplied Information

The Client is responsible for the accuracy of information, dimensions, plans, brand assets and other materials supplied for the project.

Street Art Concepts is not responsible for errors arising from incorrect information supplied by the Client.

27. Permissions & Approvals

Unless expressly included within the agreed project scope, the Client is responsible for obtaining any necessary:

  • Property-owner permissions
  • Body corporate approvals
  • Development or planning approvals
  • Council permissions
  • Heritage approvals
  • Signage approvals
  • Brand or intellectual property permissions
  • Other third-party consents

Street Art Concepts can provide artwork information reasonably required to assist with approval processes where agreed.

28. Workshops & Participants

Where Street Art Concepts provides workshops, the Client or organising body is responsible for providing accurate information about participant numbers, ages, venue requirements and any relevant supervision or accessibility requirements.

Where participants are minors, appropriate supervision and permissions remain the responsibility of the school, parent, guardian or organising body unless otherwise agreed.

Specific workshop safety and material requirements may be provided separately.

29. Third-Party Contractors

A project may involve independent artists, equipment suppliers, access providers, builders or other contractors.

Where Street Art Concepts directly engages third parties as part of the agreed project scope, their costs and role will be incorporated into the project arrangements as appropriate.

Where the Client engages a third party directly, responsibility for that contractor remains with the Client.

30. Events Beyond Reasonable Control

Street Art Concepts will not be responsible for failure or delay caused by circumstances beyond reasonable control, including severe weather, natural disasters, government restrictions, site closures, supply disruptions, illness or other events that could not reasonably have been prevented.

Where this occurs, both parties will work reasonably to reschedule or determine an appropriate way forward.

31. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other legislation that cannot lawfully be excluded, restricted or modified.

Where liability can lawfully be limited, any limitation will apply only to the extent permitted by law.

32. Resolving Problems

If either party has a concern regarding the project, they should raise it as soon as reasonably possible.

Street Art Concepts and the Client agree to make reasonable efforts to discuss and resolve project issues in good faith before pursuing formal dispute resolution.

33. Governing Law

These Project Terms & Conditions are governed by the laws applicable in Queensland, Australia.

The parties submit to the jurisdiction of the courts and tribunals of Queensland and any applicable Commonwealth jurisdiction.

34. Acceptance

Acceptance of a Street Art Concepts quote, payment of a requested deposit or written instruction to commence work constitutes acceptance of these Project Terms & Conditions together with any project-specific conditions contained in the relevant quote or agreement.
